  4. We honor your right to control the sharing of information contained within your recorded experiences and strive to make it easy for you to make decisions with regards to that information—including what is private and public as well as choosing to permanently delete any information

Privacy Policy for the My Witness Tree Website and My Witness Tree Mobile App

My Witness Tree is a comprehensive tool that allows users to recognize, record, reflect on, categorize, and share their connections and experiences with God. The following privacy policy covers both the website and the mobile application. The purpose of this privacy policy is to inform you how we obtain, use, store and share your personal data. Certain parts of Privacy Policy may not be applicable to the website and/or app. Please read through it carefully.

Personal Information We Collect and Its Purpose

The reason we gather information is so you can purchase MWT kits, in addition to giving you access to the services provided by the My Witness Tree mobile app. Some of this information is voluntarily provided by you, some is collected by us as you use the app or website, and some is collected by 3rd parties. We only collect information for necessary reasons and use it to improve our service to you. All users are responsible for any third party personal information/data obtained, published, or shared through the application. The following is a list of the data and information we obtain through the previously mentioned channels:

  1. Account Information- Includes name and email address. May include telephone number, password, and passcode. The purposes of obtaining this information includes creating an account and profile in the mobile app. If you choose not to provide this information, it is not possible to create an account, a password and/or a passcode in the mobile app. This information can also be used for making a purchase on the website.

  2. Fingerprint and/or Biometric recognition- used to confirm your identity for the sole purpose of protecting unauthorized access to your account and information. Most mobile devices have native capacity for fingerprint or biometrics and use this form of identity verification. This information is not stored by MWT but is process and stored on your device. The MWT app simply requests access to this biometric data for the purpose of authentication.

  3. Your personal experience entries- Your personal experiences are just that—personal and private. The only time another person will have access to any one of your experiences is if you provide them access to that experience through a personal invite. You also have full control over removing access to any experiences you may have previously granted. Because your entries have end to end encryption, you can have full confidence that they are safe.

  4. Payment Information and Handling- when making purchases on the website or in-app purchases, we will need to get payment information to complete the transaction. This may include credit card information. If purchasing a physical kit from the website, we would also need to obtain the mailing address the kit needs to be sent to. Lastly, it is necessary for us to keep a record of your purchases.

  5. Log Information, Usage Data, and Location- As is normal for such services and applications, when you access the MWT website or use the mobile app, we obtain information from web browsers, mobile devices, and servers. This information includes things like IP address, language type, time of access, OS, browser, and mobile network info. This information is collected automatically when using the application or visiting the website. We also collect information about your device type, wireless carrier, device ID, and how you are using the services provided. Should there be situations where your app crashes on the device being used, we will collect information that will be utilized to identify and resolve the issue. We also may identify the location of where you are accessing the website or mobile app in order to better support our user base. Unless specific otherwise, all data requested by the MWT application is mandatory and failure to provide is data may make it impossible for the MWT app to provide its services.

  6. Cookies- Any use of cookies—or of other tracking tools—by this application or website or owners of third party services serves the purpose of providing the service required by the user, in addition to any other purposes described in the present document.

  7. Third-Party- When creating a mobile app MWT account through another service, such as Google or Apple, we obtain some basic information from them as a result which may include your name, email address, etc to gain access to the application.

  8. Data/Information with your Consent- MWT may submit a request that you grant us access to information outside of your specific experiences but relevant to those experiences such as categorization or intensity rating information. This information would be used for research and academic purposes in gaining greater insight into what types, the intensity, and the frequency of experiences users are recording.

Use of your Data/Information

Your data/information is collected to allow MWT to provide its services, comply with our legal and financial obligations, respond to enforcement requests, protect our rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, provide platform services and hosting, display content from external platforms, and handle payments.

  1. Handling payments(Square)- Unless otherwise specified, the website and/or mobile app processes any payments by credit card or other means via external payment service providers. In general and unless where otherwise stated, users are requested to provide their payment details and personal information directly to such payment service providers. MWT isn’t involved in the collection and processing of such information. Instead, MWT only receives notification by the payment service provider as to whether the payment has been successfully completed.

  2. Platform services (Squarespace) and hosting- These services have the purpose of hosting and running key components of this Application, therefore allowing the provision of this Application from within a unified platform. Such platforms provide a wide range of tools to MWT – e.g. analytics, user registration, database management, e-commerce, payment processing – that imply the collection and handling of Personal Data.
    Some of these services work through geographically distributed servers, making it difficult to determine the actual location where the Personal Data are stored.

  3. Display Content from external platforms (Google Fonts)- This type of service allows you to view content hosted on external platforms directly from the pages of the website or mobile app and interact with them. Such services are often referred to as widgets, which are small elements placed on a website or app. They provide specific information or perform a particular function and often allow for user interaction.
    This type of service might still collect web traffic data for the pages where the service is installed, even when users do not use it.

  4. Legal Obligations under fraudulent or unlawful activity- We may disclose information about you if we believe in good faith that such disclosure is necessary to (a) resolve disputes, investigate problems, or enforce our Terms of Service; (b) comply with relevant laws, or warrants, subpoenas, court orders, and other enforceable legal process; or (c) protect the property or rights belonging to My Witness Tree, you, third parties, or the public at large. For example, if we have a good faith belief that there is an imminent danger of death or serious physical injury, we may disclose the least amount of information as possible to address the emergency without delay.

  5. Anonymous Information- We reserve the right to gather and disclose information that is completely anonymous and cannot be reasonably used to identify you publicly without restriction.

Sharing your Data/Information

  1. Third-Party Vendors- In order to provide you with the best service possible, it may be necessary for MWT to share your information with such vendors who provide support/services such as payments providers (Square or Stripe), cloud storage (Amazon AWS), and SMS/Email messaging (Clicksend). Third party vendors are under agreement to maintain privacy standards in order to share information with them.

Data/Information Retention

Unless specified otherwise in this document, personal data will be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the users’ consent. Following account deletion, revocation of consent or a written deletion request, your personal data will be retained for no less that 5 days and no longer than 30 days. Within that window of time, all of the entries, their attachments, and your account data will be permanently deleted.

Security

We consider security paramount and have created measures to ensure your information is heavily fortified. No online/digital services can claim 100% security. However, want you to know that we work hard to protect your information against unauthorized access, use, alteration, or destruction, and take reasonable measures to do so. We provide all your entries with end-to-end encryption so only you have access unless otherwise granted by your personal invitation.

Your Rights based on the General Data Protection Regulation or GDRP

Users may exercise certain rights regarding their Data processed by the Owner.

In particular, users have the right to do the following, to the extent permitted by law:

  • Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their personal data.

  • Object to processing of their data. Users have the right to object to the processing of their data if the processing is carried out on a legal basis other than consent.

  • Access their data. Users have the right to learn if data is being processed by the owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the data undergoing processing.

  • Verify and seek rectification. Users have the right to verify the accuracy of their data and ask for it to be updated or corrected.

  • Restrict the processing of their data. Users have the right to restrict the processing of their data. In this case, the owner will not process their Data for any purpose other than storing it.

  • Have their Personal Data deleted or otherwise removed. Users have the right to obtain the erasure of their data from the owner.

  • Receive their Data and have it transferred to another controller. Users have the right to receive their data in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance.

  • Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

Users are also entitled to learn about the legal basis for data transfers abroad including to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the owner to safeguard their data.

US Privacy Laws

Laws in some US states require us to provide residents with additional information about the categories of personal information we collect and share, where we get that personal information, and how and why we use it.

In the last 12 months, we collected the following categories of personal information, depending on the Services used:

  • Identifiers (like your name, contact information, and device and online identifiers);

  • Commercial information (your billing information and purchase history, for example);

  • Characteristics protected by law (for example, you might provide your gender as part of a research survey for us);

  • Internet or other electronic network activity information (such as your usage of our Services);

  • Geolocation data (such as your location based on your IP address); and

  • Audio, electronic, visual or similar information (such as your photos, if you upload them)

In some US states you have additional rights, subject to any exemptions provided by your state’s respective law, including the right to:

  • Request a copy of the specific pieces of information we collect about you and, if you’re in California, to know the categories of personal information we collect, the categories of business or commercial purpose for collecting and using it, the categories of sources from which the information came, and the categories of third parties we share it with;

  • Request deletion of personal information we collect or maintain;

  • Request correction of personal information we collect or maintain;

  • Opt out of the sale or sharing of personal information; 

  • Receive a copy of your information in a readily portable format; and

  • Not receive discriminatory treatment for exercising your rights under the CCPA.

We do not “sell” or “share” your personal data as those terms are defined under the privacy laws of the relevant US states. We also do not have any knowledge of any “sales” or “sharing” of the personal data of minors under 16 years of age. We do not collect or process your sensitive personal information except where it is strictly necessary to provide you with our service,  where the processing is not for the purpose of inferring characteristics about you, or for other purposes that do not require an option to limit under California law.

Details about the right to object to processing

Where personal data is processed for a public interest, in the exercise of an official authority vested in the owner or for the purposes of the legitimate interests pursued by the owner, you may object to such processing by providing a ground related to you particular situation to justify the objection.

You must know that, however, should your personal data be processed for direct marketing purposes, you can object to that processing at any time, free of charge and without providing any justification. Where you object to processing for direct marketing purposes, the personal data will no longer be processed for such purposes. To learn whether the owner is processing personal data for direct marketing purposes, you may refer to the relevant sections of this document.

How to exercise these rights and appeals

Any requests to exercise your rights can be directed to My Witness Tree through the contact details provided in this document. Such requests are free of charge and will be answered by us as early as possible and always within one month, providing you with the information required by law. Any rectification or erasure of personal data or restriction of processing will be communicated by MWT to each recipient, if any, to whom the personal data has been disclosed unless this proves impossible or involves disproportionate effort. At your request, MWT will inform you about those recipients.

We’ll need to verify that you are the right person before we disclose or delete anything if you contact us about one of your rights under this section. If we cannot verify you are the account holder, we may deny your request to access or delete information contained within the account being requested. If this occurs, you will receive notification in writing. At that time, you may submit an appeal which will be reviewed by another person not involved in the original request. Should your appeal be denied again due to an inability to verify the account, an appeal may be submitted to the state in which you reside. Instructions on how this may be done will be provided at the time of the second denial.

Child Usage Restrictions

Our services are not directed or offered to children under the age of 13. We do not obtain, collect, or store information for users under the age of 13. The mobile application has been created to allow a parent to add child profiles to their account. However, the account and all profiles are under complete control and management of the parent account holder. Any experiences created with associated information and media is the sole responsibility of the account holder. MWT assumes all information created and stored under an adult account is owned by the adult. MWT releases full responsibility to the account holder for adding and managing any added child profiles. Should MWT become aware of an account holder under the age of 13, we will takes steps to remove that account and user from our system and databases and eliminate future access.

Changes to this Privacy Policy

My Witness Tree reserves the right to make changes to this privacy policy at any time by notifying its users on this page and possibly within the application and/or - as far as technically and legally feasible - sending a notice to users via any contact information available to MWT. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom.

Should the changes affect processing activities performed on the basis of the your consent, My Witness Tree shall collect new consent from you, where required.
